Par exemple, si un(e) salari\u00e9(e) prend une semaine de cong\u00e9s du lundi au dimanche, l\u2019employeur compte six jours ouvrables.<\/p>\n<p data-start=\"471\" data-end=\"644\">La p\u00e9riode de r\u00e9f\u00e9rence va du 1er juin au 31 mai de l\u2019ann\u00e9e suivante. Le salari\u00e9 acquiert les cong\u00e9s d\u00e8s le premier mois travaill\u00e9 et peut les prendre imm\u00e9diatement apr\u00e8s.<\/p>\n<p data-start=\"646\" data-end=\"874\">Le salari\u00e9 doit prendre ses cong\u00e9s. Il ne peut pas renoncer \u00e0 son droit au repos contre un paiement suppl\u00e9mentaire. Il est recommand\u00e9 d\u2019en parler d\u00e8s que possible pour bien s\u2019organiser, surtout si l\u2019auxiliaire de vie en CESU travaille pour plusieurs employeurs.<\/p>\n<p data-start=\"312\" data-end=\"501\">Le salari\u00e9 doit b\u00e9n\u00e9ficier d\u2019au moins 12 jours cons\u00e9cutifs de cong\u00e9s entre mai et octobre, p\u00e9riode dite \u201cestivale\u201d. Le cong\u00e9 principal ne peut pas d\u00e9passer 24 jours ouvrables cons\u00e9cutifs.<\/p>\n<p data-start=\"503\" data-end=\"698\">Dans certains cas, l\u2019employeur peut imposer des cong\u00e9s (par exemple d\u00e9part en vacances ou fermeture estivale du domicile). Le salari\u00e9 doit \u00e9conomiser cette somme pour ses cong\u00e9s.<\/p>\n<\/li>\n<\/ol>\n<p data-start=\"553\" data-end=\"705\">Si l\u2019auxiliaire de vie a des horaires r\u00e9guliers, le CESU oblige l\u2019employeur \u00e0 la mensualiser, quel que soit le nombre d\u2019heures ou de jours travaill\u00e9s.<\/p>\n<p data-start=\"707\" data-end=\"726\"><strong data-start=\"707\" data-end=\"724\">En pratique :<\/strong><\/p>\n<ul data-start=\"728\" data-end=\"1007\">\n<li data-start=\"728\" data-end=\"871\">\n<p data-start=\"730\" data-end=\"871\">Pour un salari\u00e9 aux horaires irr\u00e9guliers, l\u2019employeur paie les cong\u00e9s \u201cau fil de l\u2019eau\u201d avec une majoration de 10 % du salaire horaire net.<\/p>\n<\/li>\n<li data-start=\"872\" data-end=\"1007\">\n<p data-start=\"874\" data-end=\"1007\">Pour un salari\u00e9 aux horaires r\u00e9guliers, l\u2019employeur applique la mensualisation. Elle doit coordonner ses absences.<\/p>\n<\/li>\n<li data-start=\"1266\" data-end=\"1478\">\n<p data-start=\"1268\" data-end=\"1478\"><strong data-start=\"1268\" data-end=\"1282\">Absences :<\/strong> le cong\u00e9 maternit\u00e9 et un arr\u00eat maladie professionnelle ne bloquent pas l\u2019acquisition des cong\u00e9s.
