En effet, celle-ci est encadr\u00e9e par la convention collective des particuliers employeurs (IDCC 3239).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Les ayants droit ou la personne en charge de la succession ont la responsabilit\u00e9 d\u2019informer le salari\u00e9 par \u00e9crit, d\u00e8s que possible, de la survenue du d\u00e9c\u00e8s. Cependant, elle devra \u00eatre pay\u00e9 au salari\u00e9 en fonction de son anciennet\u00e9 (m\u00eame pr\u00e9avis que pour le licenciement).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Une indemnit\u00e9 de licenciemet, si le salari\u00e9 \u00e9tait en CDI depuis au moins 8 mois sans interruption \u00e0 la date de fin de contrat (date du d\u00e9c\u00e8s de l\u2019employeur) :<\/span><\/li>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Elle est \u00e9gale \u00e0 1\/4 de mois de salaire brut par ann\u00e9e d&rsquo;anciennet\u00e9 (anciennet\u00e9 au moment du d\u00e9c\u00e8s + pr\u00e9avis = anciennet\u00e9 pour le calcul de l\u2019indemnit\u00e9).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Elle est proportionnelle si l\u2019anciennet\u00e9 est inf\u00e9rieure \u00e0 un an.<\/span><span style=\"font-weight: 400;\"><\/span><\/li>\n<\/ul>\n<\/ol>\n<p><span style=\"font-weight: 400;\">\u00a0Par exemple,\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Une auxiliaire de vie avec une anciennet\u00e9 de 2 ans et 4 mois au moment du d\u00e9c\u00e8s, aura donc un pr\u00e9avis pay\u00e9 et non effectu\u00e9 de 2 mois, soit 2 ans et 6 mois d\u2019anciennet\u00e9 pour le calcul de l\u2019indemnit\u00e9.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cette salari\u00e9e avait un salaire brut de 800 \u20ac\/mois.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Le calcul se fera donc ainsi :\u00a0<\/span><\/li>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">((800 \u20ac \/ 4) x 2 ans) + ((800 \u20ac\/ 4) x 6 mois)\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">((800 \/ 4) x 2) + ((800 \/ 4) x 6\/12)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">(200 x 2) + (200 x 6\/12)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">400 + 100<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Elle aura donc droit \u00e0 500 \u20ac d\u2019indemnit\u00e9 de licenciement.<\/span><\/li>\n<\/ul>\n<\/ul>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00a0\u00bb4.27.4&Prime;
