L&#8217;employeur doit donc le pr\u00e9ciser clairement afin de pr\u00e9venir tout litige.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">La proc\u00e9dure de licenciement avec convocation, entretien, notification, est la r\u00e8gle. L&rsquo;article 161.1.1.1 de la convention collective la d\u00e9crit en d\u00e9tail. Mais elle conna\u00eet des exceptions notables selon le motif.\u00a0<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Structurel ou financier : <\/b><span style=\"font-weight: 400;\">Un d\u00e9m\u00e9nagement ou une entr\u00e9e en institution sont des motifs l\u00e9gitimes de rupture. \u00c9galement, l&#8217;employeur peut justifier l&rsquo;incapacit\u00e9 de maintenir le contrat par un motif dit \u00e9conomique. Pour ce dernier, le code du travail d\u00e9crit une proc\u00e9dure sp\u00e9cifique. Le particulier employeur ne peut pas l&rsquo;appliquer. Ainsi que le motif soit structurel ou financier, l&#8217;employeur doit suivre la proc\u00e9dure de la convention collective. De plus, l\u2019indemnit\u00e9 de licenciement doit \u00eatre vers\u00e9e si le salari\u00e9 remplit les conditions d\u2019anciennet\u00e9.<\/span><span style=\"font-weight: 400;\"><\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\"><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>D\u00e9c\u00e8s de l&rsquo;Employeur :<\/b><span style=\"font-weight: 400;\"> C&rsquo;est le seul cas de rupture automatique du contrat de travail (Article 161.4.1 de la CCN). L&#8217;employeur ne peut pas appliquer la proc\u00e9dure de licenciement classique. Le contrat prend fin \u00e0 la date du d\u00e9c\u00e8s. La seule diff\u00e9rence est l&rsquo;absence de versement des indemnit\u00e9s de pr\u00e9avis et de licenciement.
