Chacun d\u2019eux peut y mettre fin \u00e0 tout moment, par exemple par une d\u00e9mission ou un licenciement.<\/span><\/p>\n<p><b>Le CDD CESU<\/b><span style=\"font-weight: 400;\"> fixe une dur\u00e9e de travail d\u00e9termin\u00e9e \u00e0 l\u2019avance. Le contrat <\/span><b>prend fin \u00e0 la date pr\u00e9vue<\/b><span style=\"font-weight: 400;\">. Pour compenser cette fin, l\u2019employeur verse au salari\u00e9 CESU une <\/span><b>prime de fin de contrat \u00e9quivalente \u00e0 10 %<\/b><span style=\"font-weight: 400;\"> de la r\u00e9mun\u00e9ration totale brute. L\u2019employeur peut conclure un <\/span><b>CDD CESU de date \u00e0 date<\/b><span style=\"font-weight: 400;\"> (par exemple du 29 octobre au 16 novembre) ou \u00e0 terme incertain. Dans ce second cas, le contrat prend fin lorsque se produit l\u2019\u00e9v\u00e9nement pr\u00e9vu lors de sa signature. Voici ce qu\u2019il faut savoir pour \u00eatre en conformit\u00e9 avec le Code du travail et la Convention collective 3239 des salari\u00e9s du particulier employeur et de l\u2019emploi \u00e0 domicile.<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">En premier temps <\/span><b>notifier la proposition de CDI<\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">L\u2019employeur doit notifier la proposition de CDI par lettre recommand\u00e9e ou remise en mains propres contre d\u00e9charge<\/span><\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ensuite <\/span><b>d\u00e9finir un d\u00e9lai raisonnable<\/b><span style=\"font-weight: 400;\"> pour le salari\u00e9e<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">L\u2019employeur doit accorder un d\u00e9lai raisonnable au salari\u00e9 pour r\u00e9pondre, il est conseill\u00e9 de le faire concorder avec le terme du CDD<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Informer france travail<\/b><span style=\"font-weight: 400;\"> en cas de refus<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Si le salari\u00e9 refuse la proposition, l\u2019employeur est tenu d\u2019<\/span><b>informer France Travail (p\u00f4le emploi) dans un d\u00e9lai d\u2019un mois<\/b><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>G\u00e9rer les indemnit\u00e9s<\/b><span style=\"font-weight: 400;\"> de fin de contrat<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Lorsque le CDD se poursuit imm\u00e9diatement par un CDI, sans un seul jour d\u2019interruption, l\u2019employeur ne verse pas la prime de pr\u00e9carit\u00e9.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En revanche, si le CDI ne d\u00e9bute pas imm\u00e9diatement, la prime de fin de contrat reste due au salari\u00e9.<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Conservation de l\u2019anciennet\u00e9 acquise<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Le salari\u00e9 conserve <\/span><b>l\u2019anciennet\u00e9 acquise pendant son CDD<\/b><span style=\"font-weight: 400;\"> lorsque le CDI encha\u00eene directement, sans rupture.
